CBD oil manufacturers and retailers will soon be clear on what they can legally sell in North Carolina. They will receive letters of law from the North Carolina Department of Agriculture and Consumer Services as part of an education drive.
State and Federal Law
FDA federal law states that CBD is considered a drug and North Carolina has set up their state laws to mirror federal laws. This means that CBD cannot knowingly and legally be added to any human food or animal feed that is to be sold. It also means that CBD health claims are prohibited as there is not enough authorized scientific evidence to prove such.
With these clear stipulations, retailers and manufacturers have a greater responsibility to their customers. What does that mean for their business? Well, anyone who does not comply with the standards set out could see an embargo or seizure of their products.
Education before Action
The North Carolina Department of Agriculture and Consumer Services embarked upon the journey to educate CBD manufacturers and retailers. There appears to be some ambiguity about what is legal and what is not.
Authorities are aware that retailers may not be fully knowledgeable of state laws regarding the addition of a drug to a food product. So they have decided to educate before they regulate.
The Department is also encouraging consumers to be smart shoppers. Consumers have a right to ask questions before making a purchase:
Like other states, the Department is being more assertive with this education drive in order to remain relevant for the future. Its main concern is the health and safety of the consumer with any product which falls under their regulatory authority. Until there is more research, manufacturers, retailers, and customer should be aware of what’s in the products.
